Prohibited Products Policy: PFAS Chemicals

Overview

Products subject to our policy on PFAS Chemicals must also adhere to other Prohibited Products Policies applicable to the Covered Products, including any requirements regarding Proposition 65, or Walmart will automatically unpublish your item.

What is the policy?

Covered Products containing intentionally added PFAS chemicals are restricted from being sold on Walmart Marketplace in the states restricting their sale. “Intentionally added PFAS chemicals” means PFAS chemicals that a manufacturer has intentionally added to a product and that have a functional or technical effect on the product.

PFAS, also known as per- and poly-fluoroalkyl substances (including PFOS, PFOA and PTFE), are synthetic chemical substances widely used in industrial and consumer products since the 1940s (collectively, “PFAS chemicals”). These chemicals provide properties such as greaseproofing; waterproofing; water repellence; stick-proofing and stain, grease, oil and water resistance.

Due to their persistence in the environment, PFAS chemicals are sometimes referred to as “forever chemicals”. A number of states have enacted laws restricting intentionally added PFAS in certain product categories (the “Covered Products”). Below are some examples of Covered Products, but note that this list is not intended to be exhaustive. If you have any questions about whether your products are covered by any PFAS laws, consult with your legal counsel.

Covered Products vary by state and may be updated periodically. You are expected to stay informed and up to date on evolving laws and regulations pertaining to PFAS, including the Covered Products in scope.

Food Packaging or Food Containers

Any package or packaging component that comes into direct contact with food or beverages.

Food or beverage containers; take-out food containers; unit product boxes; liners; wrappers; serving vessels; eating utensils; straws; food boxes; disposable plates, bowls and trays

Carpets and Rugs

Fabric products marketed or intended for use as floor coverings in households or businesses.

Commercial or residential broadloom carpet, modular carpet tiles, artificial turf, a pad or underlayment used in conjunction with a carpet

Cookware

Durable houseware items used to prepare, dispense, or store food, foodstuffs or beverages.

Pots, pans, skillets, grills, baking molds, trays, bowls, cooking utensils

Juvenile Products

A product designed for use by infants or children under 12 years of age.

In certain states, “juvenile products” does not include: electronic products, including personal computers and any associated equipment; audio and video equipment; calculators; wireless phones; gaming consoles; handheld devices incorporating a video screen and any associated peripheral device (such as a mouse, keyboard, power supply unit or power cord); an internal component of a juvenile product that would not come into direct contact with a child's skin or mouth during reasonably foreseeable use and abuse of the product; and adult mattresses.

Baby or toddler foam pillow; bassinet; bedside sleeper; booster seat; changing pad; child restraint system for use in motor vehicles and aircraft; co-sleeper; crib mattress; floor play mat; high chair; high chair pad; infant bouncer; infant carrier; infant seat; infant sleep positioner; infant swing; infant travel bed; infant walker; nap cot; nursing pad; nursing pillow; play mat; playpen; play yard; polyurethane foam mat, pad or pillow; portable foam nap mat; portable infant sleeper; portable hook-on chair; soft-sided portable crib; stroller; toddler mattress

Fabric Treatment

A product applied to a fabric to give the fabric one or more characteristics, including stain resistance and water resistance.

Fabric and upholstery protectors such as Scotchgard, stain removal sprays

Ski Wax or Related Tuning Products

A lubricant applied to the bottom of snow runners, including but not limited to skis and snowboards, to improve their grip or glide properties. Ski wax includes related tuning products.

Ski or snowboard wax

Oil and Gas Products

Any hydraulic fracturing fluids, drilling fluids and proppants.

Notes

These are general definitions that are for the purpose of guiding sellers to understand whether the products they choose to offer for sale on Marketplace may be subject to state PFAS laws. It is the seller’s responsibility to confirm that their product is subject to PFAS laws in any state where the product may be shipped.

  • Any products that have “Free of Intentionally Added PFAS (PFOA, PFOS, PTFE)” or other similar claim in the product listing or in any product images without a valid certificate of conformance from the product manufacturer
  • Any Covered Products that contain intentionally added PFAS
  • Cookware, provided the intentionally added PFAS chemical is disclosed on the product label, including on the product listing for online sales
  • Any Covered Products that do not contain intentionally added PFAS
  • Any products that have “Free of Intentionally Added PFAS” or other similar claim that seller can substantiate with a valid certificate of conformance from the manufacturer
