Walmart Canada Marketplace Electronics Guide

Overview

Sellers must comply with all federal, provincial, local laws and Walmart policies applicable to their products and product listings on Walmart Canada Marketplace.

 

Anyone selling on Walmart Canada Marketplace must take the time to learn about the requirements under Canadian law governing electronic equipment. 

 

Walmart Canada Marketplace relies on its Prohibited Products Policy. It reserves the right in its agreements with sellers to remove products and remove sellers who do not comply with the law and its policies. This page is intended to provide sellers with a helpful resource to learn about the rules and regulations that might be relevant to electronic device sales through our Marketplace and to direct Sellers to additional sources of related information. 

Radio Frequency (RF) Devices

Any product offered for sale on Walmart Canada's Marketplace that is subject to the Innovation Science Economic Development (ISED) Canada rules and regulations governing the use of radio frequency (RF) energy must be certified under the applicable ISED equipment rules and regulations.
Radio frequency (RF) devices can interfere with licensed radio communications, so they must be authorized under appropriate ISED rules before they can be advertised, imported, sold, or used in Canada. Also, the ISED requires certain information to be placed on the product and the information provided to users. For more information, visit the links below.
 
These requirements apply to devices that intentionally emit RF energy and devices that use RF energy internally in their operation.
 
  • These devices must be tested to demonstrate compliance with the ISED’s RF emissions standards.
  • Devices that intentionally emit RF energy must be labelled with an ISED ID number (Shown as IC ID number on devices).
  • Specific ISED information must either be printed on the device and or in the materials made available to users.

Examples of devices that intentionally emit RF and require ISED authorization include, but are not limited to:
  • Cellular and other mobile phones
  • Devices with cellular, Wi-Fi, Bluetooth or other wireless connectivity, such as wireless routers, electronic tablets, two-way radios, Bluetooth speakers, radio-controlled toys, wireless microphones, and drones
  • Automatic identification system (AIS) devices
  • Signal boosters
  • Broadcast transmitters, such as FM modulators

Examples of devices that use RF energy internally in their operation, but do not intentionally emit RF energy. The devices below require ISED authorization as well.
  • TV and radio receivers
  • Computers and computer peripherals
  • Smart battery chargers
  • LED signs
  • Other devices that contain digital circuitry that uses radio frequencies within the product.

Permissible Frequency or Channel Use in Canada

Equipment must operate on authorized or permissible frequencies or channels. Canada prohibits operation on specific frequencies or channels that other countries allow. For example, Canada allows FM modulators to operate on frequencies ranging from 88 MHz to 108 MHz, while other countries allow FM modulators to operate on 87.5 MHz.
Similarly, other countries allow consumers to operate on frequencies that consumers cannot use in Canada, such as on specific channels restricted to Federal government use or public safety use.  Suppose a consumer device is manufactured or modified to operate on frequencies that are not available for consumer use in Canada. In that case, it cannot be imported, advertised, sold, or operated within Canada.

How Does ISED Canada Alert Sellers About Changes to Rules and Regulations in the Market?

  • ISED periodically communicate updates and potential enforcement advisories through their general notices, so you should check the ISED’s website often for updates and new developments.
  • Sellers are independently responsible for ensuring compliance with ISED regulations. More information can be found by reviewing the Radiocommunication Act.



Why is this Information Important?

The ISED relies on manufacturers, importers, and sellers to abide by their rules. Non-compliance to ISED regulations may result in regulatory fines and other penalties such as inventory seizure.
 Besides potential penalties, sellers should consider the adverse effect on their business reputation, the costs of defending enforcement actions, and the disruptions to their day-to-day business operations. Also, sellers will be responsible for any damages to Walmart Canada Marketplace according to the contractual arrangements applicable to its use of the Marketplace.
